Former Chelsea doctor Eva Carneiro has instructed her lawyers to pursue a claim of constructive dismissal against the club after being banished from her duties by manager Jose Mourinho..

The serving of legal papers on the club this week could trigger an employment tribunal next year should an out-of-court settlement fail to be agreed. The three-month period in which a claim must be notified ends on 8 November.

Mourinho described Carneiro as “naive” and dropped her as well as physio Jon Fearn from first-team duties for opting to issue on-field treatment to playmaker Eden Hazard while Chelsea were already down to 10 men against Swansea on the opening day of the season.the season.

The Portuguese was cleared of using discriminatory language by the Football Association, although the governing body and Carneiro were at loggerheads as to whether the 42-year-pd was given the opportunity to contribute to the investigation.

Developments in the Carneiro saga are the latest setback in a sorry season for Chelsea, who lie 15th in the Premier League after a catastrophic start to the campaign. The Blues exited the Capital One Cup on Tuesday after losing a penalty shootout at Stoke.

Chelsea midfielder Ramires, meanwhile, has signed a new contract which is set to see the 28-year-old remain at Stamford Bridge until 2019.

Ramires has won the Premier League, Champions League, Europa League, FA Cup and League Cup since joining Chelsea from Benfica in 2010.
